1. Introduction and scope

Welcome to LookAlbania, the digital gateway to Albania’s premier hospitality and tourism experiences. These Terms and Conditions (“Terms”) govern the use of our platform, which connects individual users (“Users” or “Guests”) with business providers (“Partners”) offering restaurant reservations, guided tours, local experiences, and event tickets.

By accessing lookalbania.al or creating an account, you agree to be bound by these Terms. If you do not agree, you must cease use of the platform immediately.

Section A: Terms for users and guests (explorers)

2. Services and bookings

The marketplace role: LookAlbania acts as an intermediary marketplace. When you book a table, a tour, or an event, the legal contract for the service is exclusively between you and the Partner.

Accuracy: We strive to ensure all information is correct, but descriptions, pricing, and availability are managed by the Partners. LookAlbania is not liable for inaccuracies provided by the Partners.

Confirmation: A booking is considered valid only when you receive a formal confirmation via email or through your LookAlbania dashboard.

3. User responsibilities

Account integrity: You must provide accurate contact details (email and phone number) to ensure Partners can reach you regarding your booking.

No-show policy: Respecting our Partners’ time is vital. Frequent “no-shows” (failing to arrive without notice) may lead to the permanent suspension of your account.

Conduct: You agree to behave respectfully toward Partners and their staff during your experience.

4. Payments, cancellations, and refunds

Prepayments: Certain tours, events, or high-demand restaurant bookings may require a deposit or full payment upfront.

Cancellation windows: Each Partner sets their own cancellation policy (for example, 24-hour notice). These policies are displayed at the time of booking.

Refunds: If you are entitled to a refund under the Partner’s policy, LookAlbania will facilitate the transaction back to your original payment method.

Section B: Terms for partners (providers)

Restaurants, tour operators, professional guides, and event organizers

5. Partner eligibility and licensing

Legal status: All Partners must be legally registered entities or licensed professionals in the Republic of Albania (holding a valid NIPT where applicable).

Specific licenses: Tour operators and guides must hold valid professional certifications as required by Albanian tourism laws.

Insurance: Partners are responsible for maintaining appropriate liability insurance for the services they provide.

6. Listings and fulfillment

Service standards: Partners agree to fulfill every confirmed booking. If a service must be cancelled, the Partner is responsible for notifying the Guest and LookAlbania immediately.

Content ownership: You grant LookAlbania a non-exclusive license to use your brand name, logo, menus, and photos for promotional purposes. You must ensure you own the rights to all content you upload.

7. Financial terms and payouts

Commissions: LookAlbania charges a service fee or commission on successful bookings or ticket sales. These rates are governed by your specific Partner Agreement.

Payout cycles: For prepaid experiences, LookAlbania collects funds and remits them to the Partner, minus the agreed commission, on a scheduled basis (for example, weekly or bi-weekly).

Section C: General provisions (applicable to all)

8. Reviews and community standards

Authenticity: Reviews must be based on a genuine experience.

Moderation: LookAlbania does not delete negative reviews unless they contain hate speech, threats, or proven falsehoods. Partners have the right to respond publicly to any review.

9. Data protection and privacy

Compliance: All data is processed in accordance with Albanian Law No. 9887 "On the Protection of Personal Data" and the GDPR.

Data usage: Partners may only use Guest data to fulfill the specific reservation and may not add Guests to marketing lists without explicit, separate consent.

10. Limitation of liability

Service quality: LookAlbania is not liable for the quality of food, the safety of a tour, or the conduct of any party during an experience.

Platform uptime: We provide the platform “as is.” We are not responsible for losses resulting from server downtime, technical glitches, or internet connectivity issues in Albania.

11. Termination

Users: You may delete your account at any time.

Partners: Partners may terminate their relationship with 30 days’ notice, provided all existing bookings are honored.

Breach: LookAlbania reserves the right to ban any User or Partner for fraudulent activity or breach of these Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Albania. Any disputes that cannot be settled through amicable mediation shall be subject to the exclusive jurisdiction of the District Court of Durrës.
